1. Introduction
Welcome to MistyHarborLane ("we," "our," or "us"). These Terms & Conditions ("Terms") dictate your usage of our yacht charter services and the website found at mistyharborlane.xyz (the "Service"), which is provided by MistyHarborLane.
When you make a booking for a charter or use our Service, you consent to adhere to these Terms. Should you not concur with any segment of these terms, you are prohibited from using the Service.
2. Service Overview
MistyHarborLane offers high-end yacht charter services that encompass:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multiple-day charters
We may alter or cease services based on availability and weather conditions at our sole discretion.
3. Booking and Reservations
3.1 Booking Process
You need to fulfill the following to book a charter:
- Attain a minimum age of 18 years
- Provide truthful and complete personal information
- Make a deposit payment as detailed in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is only deemed confirmed upon our receipt of your payment and our issuance of written confirmation. We retain the authority to deny service to anyone at our discretion.
3.3 Availability
Charters depend on vessel availability and favorable weather conditions. We strive to accommodate your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All of our quoted prices are in € and inclusive of any applicable taxes unless mentioned otherwise. These prices can change without prior notification.
4.2 Payment Schedule
- Deposit: Payment of 50% of the full charter price is required at booking
- Balance: To be paid 48 hours in advance of the charter departure
- Extra fees (if any): To be settled at the end of the charter
4.3 Payment Methods
We accept a range of payment options including major credit cards, bank transfers, and certified cheques. Payment processing is done using secured, encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours in advance of departure: Full reimbursement, less any processing fees
- Cancellation 24-72 hours before departure: Entitled to a 50% refund
- Cancellation less than 24 hours before departure: No reimbursement provided
5.2 Weather Cancellations
In the case that our captain deems the weather conditions to be unsafe, we offer to:
- Schedule the charter for another date, if possible, at no extra cost
- Issue a full refund if rescheduling is not feasible
5.3 Mechanical Issues
Should there be any mechanical issues with the vessel assigned to your charter, we will attempt to arrange an appropriate alternative. If an alternative is unavailable, we will provide a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Comply with all directives given by the crew
- Utilize the safety equipment when it is requisite
- Inform us of any health conditions that could influence their safety
- Stay within the designated areas aboard the vessel
6.2 Prohibited Items
The following items are not permitted aboard:
- Glassware
- Illegal substances
- Firearms or any form of weapons
- Excessive amounts of beverages (extending beyond reasonable consumption)
- Pets (unless approval has been granted beforehand)
6.3 Conduct
Passengers must behave respectfully. Should any guest behave in a way that is a safety hazard or disrupts the pleasure of others, we retain the right to end the charter immediately without refund.
7. Liability and Insurance
7.1 Our Liability
Our responsibility in terms of liability is limited to the charter fee paid. We are not accountable for:
- Injuries sustained due to the negligence of passengers
- The loss or damage of personal items
- Indirect or consequential damages and punitive damages
- Delays related to weather or other unavoidable circumstances
7.2 Insurance Coverage
We maintain full marine insurance that covers our vessels and operations. It is up to our passengers to secure their own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our charter services, you recognize that activities on the water come with inherent risks and you assume personal liability for your safety and welfare.
8. Modifications and Itinerary Changes
Should it be necessary, we hold the right to alter travel itineraries, routes, or schedules due to reasons such as weather, safety concerns, or operational needs. We will always aim to provide an experience of comparable value.
9. Force Majeure
We are exempt from obligations resulting from delays, cancellations, or service changes caused by events beyond our control, which include but are not limited to:
- Extreme weather conditions
- Natural catastrophes
- Governmental mandates
- Port closures
- Vessel mechanical malfunctions
10. Privacy and Data Protection
Your personal data is managed according to our Privacy Policy. By using our services, you agree to the collection and processing of your data as outlined in that policy.
11. Intellectual Property
The materials on our website, including but not limited to text, images, logos, and graphics are protected by copyright and trademark law. Unauthorized reproduction, distribution, or derivative creation is prohibited without explicit written consent from us.
12. Governing Law
The laws of Malta preside over these Terms and any disputes are to be settled in the courts of Valletta, Malta.
13. Changes to Terms
We maintain the right to revise these Terms at any time. Any such amendments will be posted on our website with an updated revision date. Continued patronage of our services affirms acceptance of the new terms.
